RIGHT TO REQUEST INFORMATION ABOUT DISCLOSURE TO THIRD PARTIES

You retain the legal right to request through email the details about our disclosure of personal information to third parties or affiliated companies that we use for direct marketing purposes. Please do so by emailing us at EuphoricDiscovery@gmail.com and permitting us up to 30 days to process your request. You may submit such a request once per year.

RIGHT TO KNOW

You have the legal right to request through email that we share with you a compilation list of the last 12 months of personal information we have collected from you, the sources from which we collected it, the company purpose for collecting or “selling” the data, and a list of “third parties” that we disclosed or “sold” that information to. You may also request that we provide you a copy of the specific details of the personal information we have collected about you in the past 12 months. You may request to know up to two times in 12 months, subject to limitations described in the law.

RIGHT TO DELETE

You have the legal right to request that we delete any personal information that Euphoric Discovery has collected from you via the website. However, the law exempts certain information from deletion, including but not limited to the information necessary for security and fraud detection. We also may store the information needed to provide you with products and content. For example, suppose you ask us to delete your data but retain your loyalty account. In that case, we will keep the information we need to continue providing you with loyalty benefits. When we respond to your email request for deletion, we will explain what information we have legally retained and for what purpose. The law does not consider anonymized or pseudonymized information to be “personal information,” therefore, we rightfully can and may “delete” your personal information by anonymizing or pseudonymizing it.

NON-DISCRIMINATION

You retain the right to be free from bias or any form of website or product limitation for exercising these rights. You will be offered the same products and content, charged the same rates, and not limited in discount and sale opportunities because you used one of these rights.

HOW TO MAKE A REQUEST

You may request to know or delete it by emailing EuphoricDiscovery@gmail.com. When you make an email request, we will need time to verify your identity before responding to protect your information, and this will entail contacting you through email to provide us with your physical address. We will send you a physical letter to this physical address with a 10-digit code, case sensitive. You must email us this code from the same email address you provided us the physical address. We will respond to your request once we confirm the code you email us.

AUTHORIZED REPRESENTATIVES

You retain the right to select an authorized representative to request data subject rights on your behalf. We will contact you through email to provide us with your physical address. We will send you a physical letter to this physical address with a 10-digit code, case sensitive. We will require verification through mail sent to 9174 Palm Island Circle, North Fort Myers, Florida, 33903, USA, that you did authorize the representative. Unless the law demands otherwise, your authorized representative must provide us with your contact details and the code you provide through email. Once you confirm, we will react to the rights request.

RIGHT TO OPT OUT OF “SALE” OF PERSONAL INFORMATION

As a California resident, you can opt out of the “selling” of your personal information to “third parties.” The law defines “sale” to include not only the trade of data for money but also any transfer of personal data to a “third party” in trade for “other valuable consideration.”

We have not and will never transfer your information to third parties in exchange for money. We share personal data with certain third parties to operate and market our business. There is potential for an individual or entity to claim that this transfer was in exchange for “other valuable consideration.” To be cautious with and respectful of your information, if you opt out, we will not share your information with any “third party” except as explained below and authorized by law.

Any data transfer to a “third party” may be deemed a “sale” of data. The law regards any other company as a “third party” unless that company agrees to explicit contractual conditions.

If you opt out of the “sale” of data, we cannot send data to some of our company vendors. Consequently, after you opt-out, you may not receive all of the marketing and other information you would otherwise receive from us.

California law stops us from asking you to “opt-in” for a year after you “opt-out.” Yet, we can contact you if a specific transaction demands data transfer to a third party. We may contact you through email if a transaction requires a transfer to a third party, in which we will ask if you wish to opt-in if you wish to resume the purchase.

Minors

We do not “sell” the data of people under 16, and we never intend to collect data related to those under 13.

Exceptions to the opt-out

The law maintains several vital exceptions for you to be aware of.

We retain the right to transfer your data to a “service provider,” regardless if you opt-out. The law does not consider that kind of transfer a “sale.” A service provider is a firm that agrees not to use your data for any purpose other than exclusively delivering the services defined in our contract with them. For example, we transfer data to company partners to supply data security and detect fraud. Those companies are what we refer to as “service providers.” Even if you opt-out, we will continue to transfer data to our service providers.

We can also share your data with a third party where you mandate the transfer or request us to share such information with the third party. For example, suppose you instruct us to use a specific payment method to pay for your purchase, even if you have opted out. In that case, we will still transfer the required data to complete your order.

Accumulating information and using it ourselves is not legally a “sale.” Opting out of the “sale” of your data does not limit us from continuing to collect and store your personal information.

The “opt-out” only applies to “personal information” that could connect to you, and we employ anonymization and pseudonymization to protect privacy. That data is not legally deemed “personal information.” Opting out will not limit our sharing of that data to third parties.

Technical limitations on opt-out

Please note that if you opt out, technical restrictions exist that limit our ability to identify data related to you that could restrict our ability to entirely prevent the “sale” of that data to other parties. In situations when we can accurately confirm the information does indeed relate to you, we will not “sell” it to “third parties” except as permitted by the law. However, we may not be able to determine that information relates to you. The information may be “sold” to a third party in that case.

Opting out does not necessitate unsubscribing

Opting out of the “sale” of personal information will not stop you from receiving our marketing emails. If you want to unsubscribe from our email list, follow the unsubscribe link at the bottom or top of one of the emails we sent to you. If you want to unsubscribe from text messages, please reply to them with STOP or END.

HOW TO OPT-OUT

If you would like to opt out of the “sale” of your data, email us at EuphoricDiscovery@gmail.com. If you want to opt out of an email address different from the email on your account or that we have on record for you, you will need to use the email process to do so. To use the email process to opt out, you or your authorized representative must provide us with the email address you want to opt out of.

We will set a cookie on your device to enable your opt-out. That cookie will allow us to identify you if you return and allow us to control data from being “sold.” Suppose you delete or replace the cookie using a different device or browser. In that case, we cannot connect the session to your opt-out or prevent the “sale” of the data. You must give us each email address if you want multiple email addresses opted out.

If you have multiple email addresses you want to opt out of, you must provide each address to us.

DO NOT TRACK

Do Not Track is a privacy preference that users can select in specific web browsers, which can then automatically exclude you from tracking by websites and online services. The World Wide Web Consortium has yet to verify universal standards for recognizable do-not-track signals. Therefore, we are unable to recognize do-not-track privacy preferences at the moment.

Under specific state privacy laws, you legally can opt out of the sale and sharing of your personally identifiable data. Email EuphoricDiscovery@gmail.com to request the form to ask us not to sell or share your personal information.

Additionally, you may learn more about what cookies we use and how to manage your Cookie Settings by visiting our Cookies section.
